My girfriend was following my car in her car as I crossed a traffic light. Unfortunately the light turned amber as I crossed and and she continued crossing. The lights went red just after she started crossing and she has received a ticket for contravening a red light.
We have recived the camera photos - her car was about half the car length over the start of the crossing when the lights turned from amber to red.
Basically this was a mistake as she was following me so as not to loose her way, but we feel that as she started crossing when the lights were still amber that she should not recieve the ticket (points %26amp; a 拢60 fine). Does anyone know if it is worth contesting this? We don't want to go to court, as feel that the 3 points and 拢60 fine would probably be cheaper though. Can I successfully contest a traffic camera ticket - light amber as the car started crossing, then went red?
No not really if you refer to the highway code is states " AMBER means 'Stop' at the stopline. You may go on only if the AMBER appears after you have crossed the stop line or are so close to it that to pull up might cause an accident" from what your saying your girlfriend was following you and so if she stopped than that wouldnt cause an accident if she was so close to you then be careful as she can aslo be accused of not leaving enough space to stop in the event of you having to pull up sharply. I do travel like this in convoy frequently when im showing people around the area i work in these days most of us have sat nav but at times we have to use the convoy system if we loose the other person following us like that we simply find somewhere safe and pull over until we see them and they join us then when its safe we pull out in to the traffic and carry on. i dont think you will get anyjoy with this one sorry
They've got her bang to rights - amber means "stop". Her only defence would be if she can show that by stopping she would've caused an accident - that's the only time you can go through on amber.
In short, the photos (as you've described them) have proven her guilt. Can I successfully contest a traffic camera ticket - light amber as the car started crossing, then went red?
No.....Only green means GO.
I agree, not worth contesting. You could put up some argument about another car following so closely that she felt it would be dangerous to stop, but I doubt if that one would fly.
I quote, "AMBER means 'Stop' at the stopline. You may go on only if the AMBER appears after you have crossed the stop line or are so close to it that to pull up might cause an accident". You said she crossed on amber. Can I successfully contest a traffic camera ticket - light amber as the car started crossing, then went red?
Technically you can get points and a fine for crossing on amber. Your girlfriend could try saying that the car in front (you) stalled at the lights, and when you started moving again she pulled away right on the change in the lights, so it was better to keep going than stop and stay stuck out into the junction, possibly blocking the pedestrian crossing.
you can have the evidence (the photo) withdrawn from the hearing due to it being inadmissable because you never received a proper caution before receiving an NIP, check out www.pepipoo.com, its a very interesting and informative if not eye-opening site.
I take it both of you have read the highway code?
Just about anything can be contested. 1) can they prove who was driving? 2) Is it possible to see any other vehicles in the shot that you might be able to claim were making it unsafe for her to stop? 3) Were the lights changing at the correct interval, was the sync right?
Amber means prepare to stop I believe, not stick your toe down and go. It's unlucky, but they won't have a bar of it.
