I want to dispute a traffic ticket I received due to a photo intersection camera. Is there a legal precedent for traffic camera tickets?
In Girard, Ohio, there were a ton of complaints about the intersection camera. I believe that one lawyer had it out with the Dept. of Transportation or something , he backed up a lot of people who had received tickets and could prove they hadn't been driving their car or their wasn't even running at the time.
I'd check on it on Google or something. I think that happened the beginning of this year, end of last.Is there a legal precedent for traffic camera tickets?
yes... just go to the city hallIs there a legal precedent for traffic camera tickets?

Tickets For Running Red Lights May Be Void
Esme Murphy
Reporting
(WCCO) Minneapolis Tuesday, a Hennepin County judge ruled that the city cameras set up at intersections to catch red light runners are unconstitutional.
The cameras, nicknamed "photo cop", take pictures of the license plate of vehicles that run red lights. They then send out tickets to the owner of the car.
Since last May, 27,000 tickets have been issued by the red light cameras and 17,000 of those have been paid. Depending on the outcome of the case, the courts will decide whether the remaining 10,000 must be paid.
Lt. Greg Reinhardt of the Minneapolis police said, "Here we had a tool that was working. It was preventing accidents, preventing injuries, preventing vehicle crashes and we no longer have that tool to use."
Because of the judge's ruling, the cameras are not doing anything right now. That has police officers worried about drivers' safety.
According to police, the photo cop has reduced serious crashes by 20 percent
But the judge agreed with the American Civil Liberties Union that photo cop is unconstitutional.
The executive director of the ACLU, Chuck Samuelson said, "Minnesota law says the cop has to give you the ticket and the driver has to get the ticket ... not the owner of the car."
The courts are saying if a driver has gotten a photo cop ticket and hasn't paid, don't.
Some drivers who paid their photo cop tickets are trying to figure out if they are out of luck or entitled to a refund.
Legal experts are divided on that question and it seems headed for the courts.
For now photo cop is permanently off duty and police are mourning the loss of an awfully efficient colleague.
"We had one officer who wrote 26,000 tickets," Reinhardt said. "One cop wouldn't right that many tickets in his whole career."
The Minneapolis City attorney has to decide by Tuesday whether to appeal the decision.
The city of Minneapolis is hoping the program continues. With tickets at $142 a ticket, Minneapolis has made a net profit of $600,000 with the photo cop.

Anybody know what the final ruling is on traffic cameras?
I was under the impression that they deemed the "red light" and "speeding" cameras, unconstitutional. Yet a friend just received a ticket. Has anyone else heard about this. Especially in Ohio?Anybody know what the final ruling is on traffic cameras?
welcome to America
the constitution changes along with the
zip codes

You might have a case if your friend got the ticket in the mail. However if an officer stopped him/her and issued the ticket there than he/she has to pay.Anybody know what the final ruling is on traffic cameras?
They're still everywhere in California.
If one doesn't run red lights, then one doesn't have to worry about them. Plus, the cameras are in a public place, so there's no constitutional breach of privacy or anything like that.
All of the cameras in California have signs posted as well.
nope we still have them in nyc.. all over the place and thats the first i've heard of it.Anybody know what the final ruling is on traffic cameras?
Got a "red light" ticket in the mail. Thing is we were making a right turn, and no signs were posted saying no turn on red. This was in Chicago.
I've not heard anything about them being unconstitutional. I'll have to look that up . . .
Houston Texas is plastered with them and getting more. Also putting cameras all over parking areas.
In Houston you are on "Candid Camera".

Speeding cameras and traffic red lights?
Hope you can help. Husband and I were nearly breaking up. I left home late night as i was really upset, and he was devastated that i left. I agreed to come back to him. He was having a nervous breakdown in the car, and was really worried about me, as it was really late night and i was on my own. So he was speeding to come pick me up, he was crying, and having a panic attack. he passed 3 cameras and 4 red traffic lights. will his licence be banned? how long for? do police ever let you off if you tell them the reason he was speeding? He is a very good driver, and is always always careful. It was just that date he did this. we both made up, but we're both worried about his driving licence. any tips advice part from not to speed again? what can we do? how long does it take for the letter to come to our house saying he cant drive anymore? we're both really worried. i asked him did you see cameras flash, he said he is pretty sure it did, but not 100% as he was in so much tearsSpeeding cameras and traffic red lights?
With regards to the speed cameras, yes he will receive notifications totalling 3 points and 拢60 per offence (providing they were live at the time). With regards to the red lights then it depends if they had cameras situated on them. If yes then again 3 points and 拢60 per offence. After 12 points your licence is automatically revoked.
If he wishes to plead his case then he can offer to have all the offences heard in a court of law. At this point though, just him saying his reasons would probably not hold up. He needs proof of the circumstances i.e. you had left so the persons whose house you went to should testify and someone will need to confirm his state of mind due to this.
One word of caution, if you elect to go to court and he is still found guilty, then they usually hand out punishment more severe than the standard (e.g. friend tried to say he was speeding due to family illness. Judge said no excuse 5 points and 拢100 fine plus costs). Not saying this is the norm but beware.
Also, it depends on the speed he was going at. If he was going more than 25mph over the speed limit then it is an automatic court case. At these speeds, multiple offences will probably earn him a ban.
Fines issued within 28 days usually however, if all the offences are from same court area, then they could just collate and send to court for their action.
Maybe his previous driving record will stand him in good stead, I don't know. Contact a solicitor in the meantime to find out all the answers. There are several that give fixed price advice for the first interview.
Best of luck and no matter what the problems, stick to the limits.
So whats the question? If he gets caught for all of it he will be banned yes!Speeding cameras and traffic red lights?
oh dear!
i have a document for you to read i will send it as attachment i need your E _Mail address it will help if you read it all.Speeding cameras and traffic red lights?
There's NO excuse. Paranoid, mental, psychopathic, whatever. All the more reason to ban him. I bet you're not going to choose this as the best answer but it's a shame the bloody drunk, unlicenced, uninsured don't kill themselves for a change.
some cameras flash but do not take images so you might get away with that, as for the lights if he was seen then unfortunately he will pay the price. even if you explain the situation i dont think it would help your case as the police hear all sorts of stories why people are speeding. sorry. i doubt he will lose his licence but he will get points and a fine so prepare yourselves for that.
Get an attorney. Being that these were all part of the same series of incidents an attorney may be able to get a reprieve such as deffer ed prosecution. The idea being he was distraught and it would not happen again. Good luck.
If he was driving while in such a distressed state he was very lucky that he didn't get killed and kill someone else while running red lights and speeding. Have you had any thoughts about that?
I wouldn't tell the police about it as they would think like me.
There is no way they will let you off, no matter what had happened. They will say that he is not trained to such an advanced level that he can drive safely when breaking the speed limit (I have just been on a "oops I was speeding and got caught" course, so I know what they will say!)
It took a couple of weeks for the letter to come out to say I had been caught.
A guy asked a similar question not so long ago.
http://uk.answers.yahoo.com/question/ind鈥?/a>
Some of the cameras flash, but are not in action (they are not issuing tickets) so you still might have got away with it.
Chances are he will get at least 3 - 6 points and a hefty fine. I doubt (if he has got caught bymore than 1 camera) that he will be offered a course as an option.
Good Luck!!
Prove to the court that the acts of speeding were committed due to nervous breakdown and passion due to an impending event regarding your relationship. Present the past records of being a good driver.

first things first.
try not 2 panic and remember losing his driving licence is nothing compared 2 losing u.
the letter, if the cameras were indeed working, will arrive fairly shortly. on it u will b asked ur views, take it along 2 the Citizens Advice Bureau and ask 4 help.
people have challenged their speeding tickets in circumstances outta of their control and been given the benefit of the doubt.
buy a sat-nav and a snooper, a device 2 warn when u r approaching a camera and update it regularly.
try not 2 listen 2 any1 on here that's 2 busy judging 2 help.
now dry ur tears and buy the stuff above and await the letter, if and when it arrives.
If he appeals against the speeding tickets etc for the reasons you give he'll be banned as he was not in an appropriate mental state to drive the car. If he doesn't appeal, 4 speed fines = 12 points = loss of license.....
sorry
Unfortunately, there is no point trying to take this up with the ticket office that would be responsible for this. His best thing would be to go to court and explain his case, however the chances are without any medical evidence than he will loose his license if he gets more than 12 points. It is not the police that decide if he should be banned it is the CPS and the court.
It may be found that he should not have been driving due to the emotional state he was in, in which case again he will be banned.
It is important to remember that he could have killed someone, particularly jumping red lights. The courts will see this the same as someone that has had a bad day, even though there is more to this.
It is 3 points per camera so thats 21 points so once the ban is finished the additional 9 points will stay on his license and quite a large fine.
Really speaking his only hope is that not more than 3 cameras actually went off. Might be worth speaking to a solicitor, most give legal advice for the first 1/2 hour or so for free.
Rosy, Dear
Amazing, what if he had killed someone. Sorry, my give a damn is broken..... how stupid can you and your husband be?
He could be sitting in prison for man slaughter. No one in their right mind will let him off. I feel sorry for you. But I feel greater sorrow for the other people you might injure or kill someday.
He's had it. Banned.
No just speeding and doing red lights, but driving without due care %26amp; attention, dangerous driving etc. Who's to say that he was all upset and crying? He might have just held-up the local off-license, stolen the car, murdered someone, anything. His word against photo evidence? won't stack up I'm afraid.
If he wasn't in a fit state to drive, it just makes things worse.
Might not get a letter - it could be that the old bill will come a-knocking bright and early one morning with a warrant for his arrest.
Best to be prepared for the worst, I'd say. Anything better is a bonus.
if you get a number of different speed camera fines, go to court and state that once you broke the speed limit you never actually slowed down, therefore you only broke the speed limit ONCE.
Then just pay one speeding fine.

Are speed cameras in the UK effective at reducing driving speeds?
I was recently on holiday in the UK (from Canada) and was quite surprised to see the number of speed cameras (or warning signs, at least) on UK highways. I know that many drivers must find them irritating, but given that violations carry fairly substantial fines, it would appear that it must be difficult for drivers to ignore them. Does anyone know how effective the traffic camera systems have been at reducing speeds, or can you point me to references that discuss their effectiveness? Are speed cameras in the UK effective at reducing driving speeds?
Speed cameras are the prostate exam of the road, nobody likes them but we're made to believe they're necessary.
The only people who like speed camera's are police and politicians because they bring in over 250 million dollars a year in revenue.
Nobody knows how many lives they save, because nobody cares.
The only good thing about them is once you know where they are, you can slow down as you come up to them and then speed off merrily as they go out of range.
They have a proven effectiveness in cutting the rate of deaths due to speeding where they are used, and are extremely effective in raising revenue.
The Conservative-led Swindon Council (note) is - has been mentioned - thinking of cutting the number of cameras (no decision yet), but not because of their proven ineffectiveness. Rather, it's because - in the first place - they are not able to keep the revenue raised, and, secondly, subsequnt research that local Tories have done apparently 'suggests' there 'may' be better ways to spend the money. Road safety is clearly being put before cash and politics: there would have been no plans to cut the number of cameras if they'd been allowed to keep the sizeable revenue...Are speed cameras in the UK effective at reducing driving speeds?
Overall it has been proven that speed camera's reduce accidents however we have gone over the top and have camera's where they are likely to actually cause an accident or offend genuine motorists....I believe If you like on ROSPA website you my get real figures
A fairer system for all would be to introduce speed limiters for cars so if your in a 30 limit you may switch your cars engine to this speed or lower ..
In Northampton UK we have one of the heaviest amounts of fines as there is a speed camera on most corners ...yet its the rural roads that suffer from fatalities the most
The most effective are the average speed cameras now being used more often at road works.
By monitoring the vehicles entering and leaving the speed restricted area, the average speed can be assessed and if the speed limit has been exceeded a speeding ticket can be issued.
In my opinion this has greatly slowed down drivers who would otherwise have just sped through. Are speed cameras in the UK effective at reducing driving speeds?
They have been in use in Australia for years. They have changed most drivers behaviour, but you still get the morons who think they are the best drivers in the world and speed limits don't apply to them.
On the opening day of a Melbourne tollway a Probationary driver, (First year) was booked at more than 50kph over the 100 kph limit and thought he was a hero because he got on TV. He wasn't so happy when his car was impounded for two days and he had to pay $560 fine plus lost his licence for three months.
.
Saving ONE LIFE means they are effective.
Drivers considering they are better than any speed limit are the problem.
I have instructed drivers with many, many years experience and the majority, 90%+ do NOT know how to brake effectively in an emergency, but they thought they could.
.
No they do not reduce driving speeds drivers only slow down for the cameras then speed up again. That is why one council in the UK, i believe it to be Swindon is taking them down and will be saving 拢400,000 a year on expenses.
the one thing these cameras cause you to do is check your speedometer far too much in certain situations which has to affect your concentration on the road overall.

What are the sensors for on the traffic cams being installed on Highway 95?
I've noticed that recently, tons of traffic cameras have been installed on Highway 95 in Florida where I live. There are so many, practically every section of road will be within reach of the cams. But I also noticed that there is some sort of flat panel transducer that is pointed roughly at the road on each camera pole. What would those things be for? They remind me of the transducers used in E-Pass lanes. Could they be used to monitor our movements? What are the sensors for on the traffic cams being installed on Highway 95?

Probably speed detectors, used to check your speed and take a picture of your plates.

How to fight ticket from traffic camera?
I got a ticket for turning red on a red light without complete stop by a traffic camera. The ticket is for $500!! I was turning right into a train station. (BART/Cal train).
I want to fight the ticket but I'm not sure where to begin. Should I find a traffic lawyer? How to fight ticket from traffic camera?
Only method that I have ever heard that worked; was a motion that the accuser be present in the courtroom, in this case the camera. But that is only as Pennsylvania has the right to have the accuser present in their state constitution.
Best off to get a lawyer, I think.
Tickets issues by camera's are civil fines, not traffic violations. They are often contracted out to private companies that operate the cameras, collect the fines and hand over a portion of the fines to the city or county. Try calling the phone number on the citation. You may be able to haggle over the fine amount. How to fight ticket from traffic camera?
my mom had to go to court last week and they ended up dismissing tons of tickets given by cameras while she sat and waited for her turn.
Dont get a lawyer. Go to contest your ticket on your own if you don't win pay up.
Lawyers aren't cheap.
take it to court, for $500, you WILL need a lawyer, and the cop WILL show up in court for $500, get a cheap lawyer that's goodHow to fight ticket from traffic camera?
You'll need a lawyer, but it will be pretty hard to beat if they have you on film making the illegal turn.
