My uncle was involved in a car accident on the knight street bridge in vancouver and the witness is saying something that didn't happen. so now it's 100% his fault which cleary, it shouldn't be. icbc is going by the witness' statement (obviously) and now there's no way for us to prove anything other than that video. Is it possible to obtain video surveillance from a traffic camera? Who do I ask/talk to about it?
I am not familiar with the area but as the above person already mentioned you can make a formal request to the agency if they maintain the equipment under a disclosure of evidence. If it is privately owned you will need the court to issue a subpoena to the owner for the footage.
I certainly would not get your hopes up to high and have a back up plan to defend yourself because in many cases the footage is of low quality, time lapsed, or just not recorded and just monitored. I know of many agencies who record over their old footage after 3 days if there are no inquires so time may be limited.
Good luck
If the matter is under police jurisdiction (i.e. traffic charges) they should have access to the video already.
If it's a civil matter, your attorney will need to request the judge issue a subpoena for the footage. Be advised that some cameras are not recorded at all times. Is it possible to obtain video surveillance from a traffic camera? Who do I ask/talk to about it?
In my city, they don't record the cameras, silly as that sounds.
If the cameras are recorded, then the recordings should be public record and a lawyer should be able to subpoena them, or submit a public records request.
Let the police investigate. You wont be able to get surveillance from a traffic camera only police and like the DA canIs it possible to obtain video surveillance from a traffic camera? Who do I ask/talk to about it?
Traffic cameras record photographs, not video.
