i was going through the light to turn left, when a taxi in front braked to avoid a pot hole i think, as the bend is rather sweeping i was already through the light. When the taxi moved on, and i also moved on. The camera flashed. I had no option but to carry on as i was already through the light and would have been a hazard to other traffic. What will happen?I want to appeal a traffic light camera fine in the UK?
If you have already crossed the line completely then there is no case to answer, and you may not even be sent the documents to charge you. If you have, then you can appeal it by stating that you had cleared the line completely before the lights changed and therefore must continue so as not to cause an obstruction.
However, you need to be careful with your argument. Had the lights already started their cycle to change? I.E. was the light on Amber when you crossed the line and had to break?
If so, they could argue that you should have not commited to the manuvour if the lights has already started their cycle and changed to amber, as you would know that from there it would be going to red as it was on Green before Amber.
If however, you bblatantlycrossed the line knowing it was red or just about red, then you don't have a leg to stand on.
If you have been issued with the document requesting you plead guilty to the offence, then plead not guilty and ask for pphotographicevidence. If it shows you 100% clear of the line when the photo was taken then you have a case to appeal it, if it doesn't then your screwed.
By 100% clear, I mean your rear wheels were over the line. If not, then you can still be classed as crossing the line when the light was on Red.
The law on traffic lights is remarkably simple. There's a white line painted across the road. If the front of your car crosses it while a red light is showing, you are committing an offence. If you braked and moved on after the front of your car had passed the stop line, there is no case to answer. If you were behind the stop line when the red light came on and then drove on, there is no defence.I want to appeal a traffic light camera fine in the UK?
im sorry but your reason will not stand up in court coz you are forgetting there is a rule that says do not enter a junction unless your exit is clear
sorry pal but they have that covered.
and the camera would not have flashed had all of your car been over the line so that means when you say you was through the light you could only have been part way over
What gareth has is correct. Another way of putting it is amber also means stop, it is quite clear on this in the highway code. If the light was amber before you crossed it then you would also have no case to appeal unless you could demonstrate it was too dangerous to stop on the amber.I want to appeal a traffic light camera fine in the UK?
You have no grounds of appeal as the sensors are placed so they only go off if the light is jumped.
it makes a difference whether you're in Scotland or England. Different laws/procedures. In Scotland it's pretty easy...
