What happens if you are caught running a red light with a traffic camera?

I -accidentally- ran a red light today (barely) at a busy intersection. Apparently there was a camera there because it flashed multiple times. Will I get fined and/or a ticket? I need to know what to expect in case I get notified. :(What happens if you are caught running a red light with a traffic camera?
What happens depends on where you live. You may not get a ticket at all. Behind that camera is a person who watches a video of your infraction. It is up to that person to decide whether or not to mail a ticket to you. After that . . .



Towns handle red light camera tickets differently. For example, in California, such tickets are criminal misdemeanors and are handled the same way as if a police officer caught you: You go to court, you get fined, you get points added to your driver's license and your insurance goes up.



In North Carolina, where I live, such tickets are civil penalties. They just fine you $50. That's it. In North Carolina, if you want a hearing, you have to pay $50 to get a hearing--where your accuser, your jury, your judge, your executioner and the people who make a profit off you, are all one and the same.



Now, you do have a choice on what to do. What I wish you would do is find a lawyer who will start a class action lawsuit against the town that will give you the ticket. I myself, with the help of lawyers who are doing this pro-bono, are starting a class action lawsuit against the Town of Cary, North Carolina this month -- for US $5.2 million. The class action lawsuit is NOT because the Town of Cary violates due process of law ($50 for a hearing is a 'business process'), the legal precedent of turning a 100 year-criminal violation to a civil penalty in order to avoid the 6th Amendment of the US Constitution, and fraud (citations are signed by a Safelight Employee claiming to be a policeman). It is NOT because of all that even though the Town of Cary is guilty of all that.



It IS because of a math error. A nasty math error. The class action is over the fact that the North Carolina Department of Transportation sets the yellow light interval by an equation with a math error in it. The math error cuts short the yellow interval -- by up to 40%. By the laws of physics, that forces a class of people who approach an intersection at a certain instance to run the red lights. Statistically, that means a lot of ticket money for the Town.



Most jurisdictions all over the world use the same equation as the North Carolina Department of Transportation.



The bogus equation comes from the Institute of Traffic Engineers (ITE) "Traffic Engineering Handbook". Most DOTs copy ITE's equation. ITE uses Newton's Laws of Motion to set up the equation, and then in the last step, ITE screwed up the math. Anybody with a high school education can see the screw up. Most people just pay the fine. They don't want to deal with the injustice. But I tell you the truth, this short yellow light thing kills people. It is not just a matter of money-making. The biggest violator of running red lights is not the drivers, but the department of transportations who screw up the length of the yellow. You can easily fight your case. The only reason why this is bubbling to the surface now, is because a red light camera flashed me, a physicist. And it so happens I use to work for the North Carolina Department of Transportation.
